Terms of Use

1. Interpretation & Definitions

• Interpretation: Capitalized terms are defined within these terms, regardless of whether they appear in singular or plural forms.
• Definitions:
  • Application: Software program "Zooly" provided by the Company.
  • Application Store: Digital distribution services like Apple App Store and Google Play Store.
  • Company: FreeRoyalties, Inc. (dba) Zooly.ai
  • Device: Any electronic device used to access the Service.
  • Entertainer: Entertainers and artists portrayed in the App
  • Feedback: Suggestions or innovations submitted regarding the Service.
  • Service: The Zooly.ai “Wake Up” application.
  • Subscription: Access to paid features of the Service.
  • User: Individual or legal entity accessing the Service.

2. User Account

• Registration: Users can register using an Apple account, but can access all features without registration as of the latest update.
• Deregistration: Users may deregister at any time and can re-register using the same Apple account.

3. Subscriptions

• Subscription Period: Subscriptions are automatically renewed unless canceled.
• Cancellations: Subscriptions can be canceled through account settings or by contacting the Company.
• Billing: Accurate payment information must be provided. In-app purchase subscriptions are governed by the Application Store’s policies.
• Fee Changes: The Company may change fees with prior notice, giving users an opportunity to cancel.
• Refunds: Generally, subscriptions are non-refundable unless required by law.

4. In-app Purchases

In-app purchases cannot be canceled after download. Billing and transactions are handled by the Application Store, and refunds for issues with purchases must be requested through the Application Store.

5. Intellectual Property

The Service and its contents are owned by the Company and/or the Entertainers and protected by copyright and trademark laws. Any unauthorized reproduction or use of the App or its content is strictly prohibited.

6. Feedback

Any feedback provided by users is assigned to the Company, or in case of ineffective assignment, licensed for unrestricted use.

7. Third-party Links

The Company is not responsible for third-party content or services accessed via the Service.

8. Termination

The Company may terminate access to the Service without notice if terms are violated.

9. Limitation of Liability

The Company’s liability is limited to the amount paid by users or $100, whichever is lower, excluding special or indirect damages unless restricted by law.

10. "AS IS" Disclaimer

The Service is provided "as is" without warranties. No guarantees are made regarding uninterrupted use, accuracy, or compatibility.

11. Governing Law

These terms are governed by the laws of the state of California, and other applicable local or international laws.

12. Dispute Resolution

Users agree to attempt informal resolution of disputes by contacting the Company first.

13. Severability & Waiver

If any provision is deemed unenforceable, it will be adjusted without affecting the remaining terms.

14. Changes to Terms

The Company may update these terms with a 30-day notice for material changes. Continued use of the Service constitutes acceptance of the revised terms.
